1. Acceptance of Terms
By using KinshipCanvas.com, you confirm that you are at least 18 years of age and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.
2. Permitted Use and Restrictions
Kinship Canvas provides web tools and fulfillment workflows for generating custom family tree charts from user-supplied GEDCOM files. You agree to use the platform solely for lawful purposes. You agree not to:
- Upload files containing malicious code, corrupted scripts, fraudulent information, or unlawful content.
- Upload materials that violate the intellectual property, privacy, or proprietary rights of any third party.
- Attempt to disrupt, reverse-engineer, or compromise platform integrity or security.
3. Intellectual Property and File Rights
- Kinship Canvas Property: The Kinship Canvas name, brand assets, site architecture, chart templates, and background artwork are the exclusive intellectual property of Kinship Canvas and may not be copied, reproduced, or distributed without prior written consent.
- Customer Data & Finished Charts: You retain full, exclusive ownership of your uploaded GEDCOM files, genealogical information, and customized output charts.
- Limited License: By uploading a GEDCOM file, you grant Kinship Canvas a limited, non-exclusive license to parse, process, cache, and render the file solely to generate previews, produce print-ready assets, and fulfill your order. File storage, automated purging, and data confidentiality are governed by our Privacy Policy.
4. Payments, Fulfillment, and Refunds
- Pricing & Billing: All transactions are processed in US dollars via our secure third-party payment processor, Stripe.
- Physical Prints: We provide a quality satisfaction guarantee. If your physical print contains manufacturing defects, shipping damage, or printing errors originating on our end, contact us at support@kinshipcanvas.com for a free replacement.
- Digital Products: Because digital assets are rendered immediately, digital downloads are non-refundable once delivered. If a technical defect prevents successful delivery or download, contact support to receive a corrected file.
5. Disclaimer of Warranties
Kinship Canvas is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our service will be uninterrupted, error-free, or compatible with corrupt or non-standard GEDCOM formatting.
6. Limitation of Liability
To the fullest extent permitted by applicable law, Kinship Canvas and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the service, including but not limited to loss of data, loss of profits, or business interruption.
7. Updates to Terms
We reserve the right to revise these Terms of Service at any time. Updates take effect immediately upon publication to KinshipCanvas.com, with the effective revision date noted at the top of the page. Continued use of the platform following an update constitutes acceptance of the revised terms.
8. Governing Law and Jurisdiction
These terms are governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to conflict of law principles. Any legal action or proceeding related to Kinship Canvas shall be brought exclusively in the courts located in North Carolina.
